5.   Joseph BYSOUTH
No IGI record found. Born c1824 at Reed (by 1851 census).
The Poor Law record of 1852 (while Joseph was on the Prison Hulk) confirms that he was born in Reed and that his father was Samuel.
Points of connection with other family members:
1) Niece of sister Sarah and William King in 1861 census belongs to no other brother (probably Harriet Sophia Bysouth born 1846).
2) Joseph's daughter-in-law Alice nee Thompson emigrated to Australia with brother Robert's wife Margaret nee Perrey.
3) No other Bysouth family having children in Reed at the time.
4) Married in same church in London as sister Sarah.

Marr reg Sep qtr 1845 at St Saviour Sk dist to Harriet DAVIS (ref FreeBMD). The banns were read 11, 18, 25 May, both of the parish.
Reference the marriage certificate, married 6th July 1845. Harriet was a silk weaver of 1 Fuller St, Bethnal Green, dau of William Davis, carpenter. Joseph was a porter, of 27 Pennington Street, St Georges East, son of Samuel Bysouth, labourer. The witnesses were William King and Sarah King (Joseph's sister and brother in law). Harriet Louisa DAVIS was bap 29 Jul 1827 at Farningham, Kent, dau of William Davis and Sophia (ref IGI). She was born 12 Nov 1824 at 6 Georges St, Camberwell, dau of William Davis and Sophia Lane, middle name sometimes spelt Luisa (ref book inscription of William Davis noted by Jefferies Genealogy).

At baptism of Harriet in 1846 they were at 111 Pennington St, he was a labourer. At the 1848 baptism he was a labourer of Eltham, Kent. At the marriage of son Henry Abel, Joseph was listed as a Brewer but this may not have been true.

Joseph was convicted of perjury at the Central Criminal Court at London, Middlesex, 3 February 1851.
"Joseph Bysouth, 27, carman, was indicted for wilful and corrupt perjury upon a certain information before James Trail, Esq., at the police court, Woolwich. Mr. Robinson prosecuted, and Mr. Payne defended.
Mr. Nokes, clerk to the magistrates at Woolwich, produced the minutes of evidence, taken at the time of the prisoner's examination, and from that and the statement of that gentleman it appeared that, on the 21st of December, a young woman, named Esther Parsley, took a bastardy summons out against a man named Cray, butler to a gentleman named Langland, living at Charlton, which came on for hearing at the court above mentioned, 4th of January, when for the defence the prisoner, who is carman to a brewer serving Mr. Langland, was called by the butler, and he most positively swore and fixed the several occasions that he had been on terms of the strictest intimacy with the girl Parsley. The magistrate, however, having heard the evidence in support of the case, adjudicated in favour of the girl, and ordered the prisoner into custody for perjury. The prisoner also swore that he had been on intimate terms with the girl's mother.
The girl was sworn, and said that prisoner only came twice to her mother's, with whom she was living. On one occasion he brought some beer into the house, and another time he only came to the door, and on both occasions her mother was there, and beyond that she did not know him. He had never taken any liberties with her.
The girl's mother was also examined, and it appeared that at the time of the alleged intimacy between prisoner and her daughter the witness was keeping house for Mr. Langland's brother. Her evidence clearly established the prisoner's falsehood.
The usher of the Woolwich police court said that on going to the cell where prisoner was locked up to inform him that the offence was a bailable one, he found him crying, and asked him what it was about. The prisoner said, "You see what they have got me into." Witness said: "Why you have never sworn falsely?" and he said, "So help me God, I know nothing about it. They offered me 20l. to swear what I did. They have got me to do it."
The jury found the prisoner guilty.
Mr. Gurney, in passing sentence, dwelt upon the heinous character of the offence of which the prisoner had been convicted, and the injurious effect it had on society, by perverting the ends of justice, adding that this case was a peculiarly cruel one, for had he succeeded in his offence, it would have been the means of depriving the poor infant of its natural support.
He was then sentenced to be imprisoned for one month, and then transported for seven years.
With a few cases in this and the other court, of a character unfit for publication, the business of the session closed. The court stands adjourned untio Monday, March the 3rd." (ref London Daily News 12 Feb 1851, supplied by D.South 2012).

His sentence was to be imprisonment for one month followed by transportation to Australia for seven years. However, this did not come about.

In 1852 there is a Poor Law Removal and Settlement Record for Harriet which is attached (ref Ancestry). It gives the names and ages of the 3 children and that Joseph was born at Reed, and that Joseph's father Samuel lives at Reed Green now.

Joseph died on 26 Jul 1854 in Unity Hospital Ship, Woolwich Arsenal (Pier), Greenwich, Kent of cholera (from his Death Certificate, reported by Jefferies Genealogy). He would otherwise have been transported as a convict. His death reg Sep qtr 1854 at Greenwich dist (ref FreeBMD). IN ADDITION Henry (while married) appears to have had another family of two children in 1881 with the visitor above in the 1871 census (her surname spelt 3 different ways). The birth was reg Dec qtr 1841 at Ely District Cambs of Clarissama WIFFIN. In the 1851 census she was listed as Clarissa Emma WIFFEN, dau of John and Phoeba Wiffen, with several siblings.

Together with children Edward Henry Bysouth (3), Emma Bysouth (1):
Claris Emma Bysouth. Head. Mar. Age 39. Florists Wife. Born Cambridgeshire, Little Port.

Henry was said by both Mary Anne and Clarissa to have died between 1881 and 1891 but his death is not registered in FreeBMD, and is not found in London Burials. In 1887 Henry was listed as father on James Bysouth's marriage, but not as deceased. So his death remains to be found.

Claris used the surname HENRY from the time of the registration of her first child in 1877, and then later, although in 1880 and 1881 she used the surname Bysouth. There is no record of a marriage between a Henry and a Wiffen so it is assumed that this is in reference to Henry Bysouth. The birth certificate of Edward Henry on 3 Aug 1877 gives her name as Claris Emma Henry formerly Wiffen, her husband Edward Henry, Fruit & Flower Salesman, and her address as 28 The Palatinate, Pollock Road, Newington. A website
http://www.british-history.ac.uk/survey-london/vol25/pp117-120 (British History Online) gives the following information: 'Adjacent to Gurney Street are two six-storey blocks called The Palatinate, erected in 1875, and designed "to provide convenient and healthy dwellings at moderate rents" to enable those "of a grade higher in the social scale" than the working class to live near their work.'

Robert Bysouth. Age 6. Born in Hertfordshire.

Robert's journeys are confusing. He is listed as a passenger (R Bysouth age 36), Feb 1870, on the ship 'Tararua' to New Zealand. He is also listed as a passenger (Robert Bysouth age 35), Jun 1871, on the ship 'Somersetshire' to Australia. If one or both of these are true, he must have travelled back to England for his marriage.

Marr reg Dec qtr 1872 at Shoreditch to Margret PERREY (ref FreeBMD). The marriage was 20 Dec 1872 at St Leonard, Shoreditch; the groom was aged 38, bachelor, Stone Mason, of 15 Mansfield St, son of Samuel Bysouth, Farmer; the bride, her name corrected to 'MARGRET PERREY', was aged 29, spinster, of Chingford Essex, dau of George Perrey, Farmer; witnesses were Henry & Jane Bysouth [probably brother, and sister-in-law Jane Smart] (ref Ancestry London Marriages).

Margret was the dau of Geo Perrey and Mary (ref her death reg). Her birth was reg Sep qtr 1844 at Epping Dist (ref FreeBMD), and bap 21 Jul 1844 at Chingford, Essex (ref IGI).

The shipping records do not show Robert's return to Victoria after the wedding. Margret arrived at Victoria Mar 1873 aboard the 'Somersetshire' (unassisted passage) aged 34. She was accompanied by Alice Bysouth aged 23, who appears to be the wife of Henry Abel Bysouth, believed to be Robert's nephew (see above).

Robert died 1905 at Heidelberg, Victoria, Australia aged 70 (Vic reg 5624).
Margret died 1910 at Melbourne West, Victoria, Australia (Vic reg 2725).
Her name was often spelt Margaret.
