It seems that a great number of boys were at play opposite Mr. Mobley's house in Observatory Street, when he came out of his house and ordered them away. According to the evidence of Parsons, he went away from defendant's house, but Mr. Mobley went up to him and hit him on the face with his fist, and made his nose bleed. He also took the stick out of his hand and hit him two or three times on the arm. Wm. Stokes gave corroborative evidence, after which the magistrates fined the defendant 2s. 6d. with 9s. costs." Together with his parents and 2 siblings:
Richard Mobley. Age 15. Born in Oxfordshire.

In 1846 Richard was in trouble with the law.
"Richard Mobley, butcher, charged with an assault on Mr. Camponovo. Mr. Tomes appeared for Camponovo, and stated the case to the Court. It appeared that early in December Mobley had bought a weather glass of Camponovo for three guineas, to be paid for on delivery, and that on Camponovo taking it home he gave him 10s. on account, with a promise to pay the remainder immediately. Applications had frequently been made, and at length Camponovo and his wife went on Monday the 12th inst. and Mrs. Camponovo told Mobley that she had been with Mr. Looker, who would make him pay. Words ensued, and Mobley called her an ill name. On this Camponovo took up a fork from the counter and said anybody that spoke so of his wife he would punish. Mobley took up a cleaver, and had not his (Mobley's) wife held his arms back he would have done him an injury. Mobley in defence said he meant to pay them, but they came to his house and abused him; he took up the cleaver in self-defence because Camponovo was threatening to run the fork into his back. Camponovo said if Mobley would bring back the glass he would return him the 10s. that was all he wanted. The Bench said they had only to deal with the assault. As to Mobley's obtaining the goods on false pretences, however strongly circumstances were made against him, was not then before them. Mobley was fined 5s. and costs 9s. or 14 days' imprisonment." (ref British Newspaper Archive, Oxford Chronicle and reading Gazette, Sat 24 Jan 1846) [Angele Camponovo (aged 52) was living in Oxford St Thomas in the 1851 census, so it is presumed this altercation occurred in Oxford.]

There is a possible marriage of Richard Mobley to either Sarah Buston or Eliza Wentworth in Jun qtr 1847 at Oxford dist, Oxfordshire (ref FreeBMD).
No further record has been found of Sarah or Eliza Mobley. The wife referred to in the previous article may have been with either of these as defacto marriage. At Richard's death it is stated that he was married, and the convict record also states that he was married.

Richard and Thomas were living at Burford in Dec 1847; it seems that Richard and Thomas were living together, and there is no mention of Richard's wife (see newspaper below); Burford is about 18 miles west of Oxford.

Richard Mobley aged 24 was charged with sheep stealing, together with his brother Thomas, and convicted on 1 Mar 1848 in Oxfordshire, and sentenced to transportation to Australia as a convict (ref Ancestry England and Wales Criminal Registers).

"Richard Mobley aged 24, and Thomas Mobley aged 22, charged with having, at Lyneham, stolen seven wether sheep, value £14, the property of Edward Freeman." (ref British Newspaper Archive, Oxford Chronicle and Reading Gazette, Sat 26 Feb 1848)

"
OXFORDSHIRE ASSIZES. GROSS CASE OF SHEEP-STEALING. Richard Mobley and Thomas Mobley were charged with having, on the 17th of December last, at Lyneham, stolen seven wether sheep, value 14 pounds, the property of Edward Freeman.
Mr. Keating stated the case to the jury, and submitted the following evidence:-
Frederick Jordan, I am shepherd to Mr. Freeman, who has a field called the Hill Ground, which joins the turnpike road, between Shipton and Chipping Norton. On the 17th of Dec. last (Friday), there were thirty-five sheep in one lot, and thirty-five in another lot; one lot was in a corner of the field, and the other near the turnpike road; I counted them at four o'clock that afternoon; left the field about five o'clock; the folds were made with net and hurdles; went into the field between seven and eight next morning; the night had been wet and windy; found the sheep out of the fold nearest the turnpike road, scattered about; one hurdle was down and the stake broken; put the sheep in the fold again, but did not count them till the Monday; saw the sheep again on Sunday; did not count the sheep on Saturday morning; when I counted the sheep on Monday morning there were only twenty-eight; the seven missing were long-wooled sheep; six were wether and the other a rig sheep. - Cross-examined by Mr. Pigot - It was my business to count the sheep every night and morning; if seven were missing it would make a difference in the appearance of the flock; did not notice this difference either on Saturday or Sunday, when I fed them.
Edward Freeman - I am a farmer, residing at Lyneham; have a field called the Hill Ground, abutting the turnpike road. On Friday, the 17th December, had a flock of sheep in that field; they were seventy in number, and in two folds, composed of netting and hurdle; that night was very wet; in such weather sheep like to keep close and quiet, and not stray about; missed some of the sheep on Monday morning; the missing ones were six wether and one ridgel or rig sheep. - Cross-examined by Mr. Pigot - I bred these sheep; the fold is half a mile from my house; did not go to the fold either on Saturday or Sunday.
Mary Ann Forbes [FORDS - see below] - I live at Witney, and am sister-in-law to the prisoners; in December last they were living at Burford; remember them coming to my house on the Thursday week before Christmas day, and breakfasted with me. They said they were going to Oxford; came on foot to my house, and left a dog, and dog-cart; saw them again the next day, between four and five in the afternoon; they came in a horse and cart; Richard Mobley came into my house; they took the dog away with them; saw nothing in the cart; they breakfasted with me the Thursday before they were taken up; my husband was at home at the time.
James Forbes [FORDS] - I am husband to the last witness; the prisoners breakfasted at my house on the Thursday - nine days before Christmas Day; they have not called at my house above once or twice in two years.
Charles Wood - I am a journeyman butcher, living in Oxford; am acquainted with the prisoners; saw them in Oxford on the Thursday before the fat meat show, about a quarter before two o'clock, at the top of George-street; had not seen them since the Summer. I spoke to them, and, in answer to a question, they told me they had been at Birmingham, but were living at Burford. I asked them if they had walked from Burford that day; they said yes. They asked me if I knew any one who would buy a sheep, and whether I knew any one who would let them a horse and cart. I asked them what they wanted it for, and they said, to go to Enstone, to look at some sheep. On the Saturday after, I saw Richard Mobley in the market, between his father's and brother's stall. I asked him how he got on; he said he had killed seven sheep; he asked me where he could get a hamper. I told him Payne was in the market, and he had better look out, as many butchers would be packing meat for London. - Cross-examined - Knew the prisoners when they lived in Oxford; their father is a butcher; saw them once buy three sheep of Mr. Young, of Kirtligton, about three years ago; also went with them to Mr. Adams, of Handbro', to fetch some lambs which they had bought of him; have seen them at different times with sheep or lambs.
William Cartwright.- I am a carrier, residing in St. Giles's, in this city. Know the prisoners. Let them a horse and cart on Friday the 17th to go to Woodstock, to fetch some sheep. They paid me 7s., and said they should not be late back. Woodstock is eight miles from Oxford. They did not return until next morning between six and seven o'clock. The prisoner, Thomas Mobley, brought the horse and cart back, and on my asking where they had been, he said to Enstone, because they could get no sheep at Woodstock, and would pay me a shilling or two more; but they did not do so.
William Russell. - I am a calf dealer, residing in St. Thomas's, Oxford. On Friday, the 17th December laast, about one o'clock, was returning from Cassington, which lies on the left of the Woodstock-road. Saw the prisoners in a cart going towards Cassington; asked them where they were going to, they said to Witney. I called on Sunday on John Mobley, and saw the carcases of seven sheep hanging up; they were bruized about very much, which I remarked at the time. They were six wether sheep and one rigged sheep. - Cross-examined by Mr. Pigot. - I am a calf dealer, and know more about veal than mutton. Have been a butcher forty years. The sheep were hung up without any concealment. Knew the prisoners had bought sheep at times.
John Fisher. - I keep a public house, the Royal Oak, at Burford. Know the prisoners. Recollect in December last they came to my house in a horse and cart, which they put up at my house. It was after dinner. It was before the fat meat show at Oxford. The prisoners left my house, and as they did not come back I sent my nephew to find them. Witney is the most direct way to Burford from Oxford. Late in the evening they came to my house for the horse and cart.
Mary Wiggins. - I live at Burford, and know the prisoners, who live near me; was in the habit of seeing them three or four times a day; have known Richard Mobley about five years. They got their living by selling sausage meat; never knew them to sell butchers' meat; they are butchers by trade. About the middle of December last heard them say they were going to Oxford on Wednesday night or Thursday morning early. Saw them after that on the 17th December, about eight o'clock; spoke to Richard Mobley, and said, what are you back from Oxford already? he said, my brother is gone with a horse and trap to Northleach to fetch a load of cattle. About ten o'clock the same evening Bartholomew Fisher came and said the horse and cart were ready, and his uncle wished they would fetch it, as he wanted to go to bed; the prisoners went with the boy. It was a very wet night. Never saw them with a horse and cart before. - Cross-examined by Mr. Pigot - Was in the habit of seeing the prisoners almost every day, and generally had a little conversation with the prisoner Richard.
Henry Barber. - I was lodging in December last at the Red Horse, at Shipton; I work on the rail;remember the prisoner, Richard Mobley, and another man coming there about eleven o'clock at night with a horse and cart; it was on Friday night, the 17th December. When they came to the Red Horse they got out, and I took care of the horse and card; they stopped about an hour; I was there when they went away; there was nothing in the cart but a coat or cloth; they went in the direction of Chipping Norton. I was taken about a month ago to Mr. Cartwright's to see a horse and cart, and recognised it as the same that stopped at the Red Horse. - Cross-examined by Mr. Pigot - The Red Horse stands at the corner of three roads; one goes to Melton, one to Chipping Norton, and one to Charlbury. Had lodged at the house about three months. Had never seen the prisoners before, but can swear to Richard Mobley being one of the persons who was at the Red Horse on the 17th of December last.
William Catch. - I am toll collector at the Dyer's Hill Gate, at Charlbury. On the 18th December, at five minutes before one, I was called up, and when I came down there were two men with a horse and cart, heavily loaded. One of them paid me the toll. Have seen the cart since at Cartwright's, and picked it out myself. They told me they were going to Oxford. - Cross-examined by Mr. Pigot. - It is the custom for butchers to travel on Friday night as Oxford market is on Saturday. It was five weeks after that I went to recognise the cart; went with Mr Freeman, who told me I was to go there to swear to the cart if I could.
Nathaniel French. - I take the tolls at Baywell Gate, near Charlbury; between one and two o'clock on Saturday the18th of December, was called up to let a cart through the gate; it was heavily loaded, and a man was with it. Saw the cart six weeks after at Mr. Cartwright's, and recognised it. - Cross-examined by Mr. Pigot - Noticed the cart particularly, as we have but few pass through the gate; observed the back part of the cart; it was a very low one. After the cart was gone two men came up.
John Shirley. - I take the tolls at Old Woodstock Gate; was called up about three o'clock on Saturday morning, the 18th of December, to let a horse and cart through; there were two men with it, and it was heavily loaded. I noticed the cart, and have seen it since at Cartwright's, where I picked it out myself.
John Mobley. - I am father to the prisoners, and reside at St. Giles's, in Oxford. In December last they came to my house to sleep; it was Thursday, December 16th; had not seen them since August last till then. They left my house on Friday, and returned on Saturday morning about six o'clock. Went to market that day, and before doing so went to the slaughter-house for a basked, and saw five or six live sheep there; they appeared to be long wooled. Remembers Russell [witness] looking at the carcases on Sunday morning; there were seven; they did not belong to me; they were slaughtered while I was away in Oxford market. Payne, the carrier, fetched the carcases away. - Cross-examined. - My sons were in the habit of buying sheep and selling them in the market, and sending them to London. I let them have the use of my slaughter-house; I am no partner with them. Have two other sons who are butchers, who have their own slaughter-houses.
Ann Mobley. - I am mother to the prisoners. On the Saturday before Christmas day, about six o'clock in the morning, I was knocked up by my son Thomas, with a horse and cart. Richard came in after. I did not see what was in the cart. I afterwards saw seven live sheep in the slaughter-house, and saw both Thomas and Richard slaughter them. Cross-examined. - I had no idea that the sheep were stolen. There was no concealment. There was a third person came with my sons to my house, but I did not notice him. I saw no dealing with him and my sons. He was there about three-quarters of an hour, and had something to eat. My sons are in the habit of bringing sheep to our slaughter-house.
William Payne. - I am a carrier residing in Oxford. On Saturday, the fat show day, I was in the market; I saw Richard Mobley, who told me to fetch seven sheep from Mr. Mobley's in Workhouse-lane, to take them to London.- Cross-examined by Mr. Pigot. - I have taken carcases to London before for the prisoner, Thomas Mobley.
Mr. Pigot made a long and able defence, in which he contended that there was no evidence to show that the sheep were stolen on Friday night, or if they were stolen at all, that the prisoners were the guilty parties. He ridiculed the idea of the witness at Shipton, as well as the turnpike-gate keepers identifying a horse and cart five or six weeks after it had passed through their gates. He admitted that the prisoners had sent seven carcases of sheep to London on the 19th of December, but they had bought them in the regular way of business, and had used no concealment with them, which they would have done had they been stolen; and as neither the prosecutor's sheep or their skins had been produced, there was no evidence that the sheep sent to London were the prosecutors. Under these circumstances, and with so much doubt about the case, he urged the jury to give the prisoners, as they were bound to do, the benefit of that doubt, and not deliver a verdict on speculation which would stamp them as felons for life, and deprive them of their liberty and banish them from their native country.
The Learned Judge summed up with the greatest care and perspicuity, and placed every feature of the case in the most intelligible light. The Jury consulted a few minutes and then returned a verdict of Guilty against both prisoners.
His Lordship in passing sentence remarked that the prisoners had been guilty of the crime of sheep stealing, and he could not refrain from saying that it was as clear a case as had ever come before him, in his judicial capacity. The case was really a very aggravated one, and he believed, that in this and other counties, no persons were so guilty of sheep stealing as small butchers, or who pretended to be butchers, and he considered it wrong for any one to have transactions or to deal with persons who were not regular butchers and kept a shop or stall. The present case was not merely stealing a single sheep, an offence which oftentimes a man was tempted to commit for the sake of his starving family and for which it went very much against his feelings to pass a severe sentence but this was for stealing seven sheep, under aggravated circumstances, by two men acting under the pretence of being butchers. He could not therefore feel the same in this case as he did when as he before remarked a man with a starving family committed the offence and he conceived that he should not be doing his duty if he did notinflict a very severe punishment for that which, but a few years ago was a capital offence and for which their lives might have been forfieted. The sentence of the Court was that they be transported beyond the seas for the term of 10 years. " (ref British Newspaper Archive, Oxford University and City Herald, Saturday 11 March 1848)
